“Expedited removal” extended nationwide

The Department of Homeland Security announced today that immigration officials will, in effect, fast-track the removal of any undocumented immigrant found within the U.S. who cannot prove they have resided in the U.S. for two years or longer. The “expedited removal” process sidesteps the immigration courts altogether. Only if the immigrant asserts a fear of persecution in their home country – and the immigration official acknowledges this – will an asylum officer interview the immigrant to determine whether she or he may speak with a judge.

In 2024, 1 Dallas area immigration attorney disbarred and another suspended

In April, Luis Roberto Campos received a 30-month fully probated suspension from April 1, 2024 to September 30, 2026 consequent to an evidentiary panel’s findings that he had failed to hold a client’s property separate from his own, and for failing to promptly provide a full reckoning of accounting of such funds and property. Campos was again sanctioned in August: for failing to keep a client reasonably informed or promptly provide them a full accounting of funds, he was subject to a 24-month partially probated suspension beginning November 1, 2024 and ending October 31, 2026. In October, a panel of the Grievance Committee disbarred Robert James Vivona for neglecting two clients’ immigration cases, failing to keep them reasonably informed, and failing to refund unearned fees.

1 Dallas area immigration lawyer disbarred, 1 reprimanded, and 1 suspended in 2023

In March, an evidentiary panel of the State Bar of Texas Grievance Committee disbarred Andrew Jaiah Kai Kai for failing adequately to supervise a non-lawyer to ensure their conduct was compatible with Kai Kai’s professional obligations. In April, Obioma S. Osimiri agreed to a public reprimand by another evidentiary panel, which found that Osimiria committed infractions including accepting a legal matter beyond Osimiri’s competence. In August, the Board of Disciplinary Appeals issued an agreed judgment suspending Kellye Sorelle from practice on account of an unspecified disability.

4 Dallas area immigration attorneys disciplined in 2022

In January, Kenneth Nkeng Fomenky received a 52-month active suspension for, among other ethical violations, failing to appear at hearings. In March, the 471st District Court of Collin County publicly reprimanded Ngoc-Anh Theresa Bui Creevy because, it found, she had not taken reasonable steps to protect a former client’s interests. In the same month, the Supreme Court of Texas accepted John Luna Mendoza‘s resignation from the bar in lieu of discipline. In December, Peov Linda Hem received a 24-month probated suspension for neglecting a legal matter entrusted to her.

3 Dallas area immigration attorneys disciplined in 2021

In December 2021, a Grievance Committee publicly reprimanded Pantea Pourabbas for accepting responsibility for a case when she knew or should have known it was beyond her experience and competence. In the same month, Don L. Jarvis Jr. received a three-year active suspension for neglecting a case entrusted to him and neglecting communication with his client; and the Supreme Court of Texas accepted the resignation, in lieu of discipline, of Courtney Dawn Croft Blankenship.
